Regulatory Landscape for Fintech in France
France's fintech sector operates within a multi-layered regulatory framework that bridges EU-wide rules with France-specific oversight. The primary regulator is the Commission Nationale de l'Informatique et des Libertés (CNIL), which handles data protection. However, financial services themselves fall under the Autorité de Contrôle Prudentiel et de Résolution (ACPR), a division of the Banque de France. This dual-regulator environment means fintech founders must track compliance across both prudential (capital, risk) and personal data dimensions.
The three core EU frameworks you must navigate are the General Data Protection Regulation (GDPR), the Digital Operational Resilience Act (DORA), and the AI Act. Each brings distinct obligations. GDPR governs how you handle customer and employee data. DORA mandates operational resilience standards—incident reporting, third-party risk management, and testing protocols. GDPR: Data Protection Requirements

The General Data Protection Regulation (GDPR) has been in full force since 25 May 2018. There is no transition phase: you must comply now. CNIL, as France's independent authority, enforces GDPR and has published specific guidance on fintech data processing at cnil.fr.

DORA: Digital Operational Resilience

DORA (Regulation (EU) 2022/2554) applies to all financial entities, including fintech firms licensed or registered in the EU. The framework entered into force on 16 December 2022, with full implementation required by 17 January 2025. This means you have until January 2025 to operationalise controls—not much time if you have not started.
DORA's core pillars are: (1) ICT risk management (Article 16–24); (2) incident reporting (Article 19); (3) digital operational resilience testing (DORT), including penetration testing (Article 25–28); and (4) third-party risk management (Article 29–30). DORA requires you to map these dependencies, assess their resilience, and maintain contractual provisions giving you audit rights and incident notification.
A mandatory deadline is incident reporting: significant ICT incidents must be reported to your regulator (ACPR for most fintech; CNIL if data protection is the primary impact) within 24 hours of discovery, then with a full report within 72 hours. Article 19(2) defines "significant" using criteria such as impact on customer transactions, reputational harm, or financial loss exceeding a threshold ACPR will specify.

Obligations for Fintech Applications
The AI Act (Regulation (EU) 2024/1689) introduces a risk-based classification framework with phased enforcement. The prohibition list (e.g., facial recognition for mass surveillance) took effect immediately upon adoption. High-risk systems have until 2 February 2025 to achieve compliance. General-purpose AI models have different rules starting 1 February 2025. Existing non-compliant systems have until 2 February 2026 to be remedied.

Three Common Compliance Pitfalls in French Fintech
Pitfall 1: Consent Overload Without Lawful Basis Clarity
Many fintech founders assume GDPR requires explicit consent for all data processing. In reality, consent is one of six lawful bases. CNIL has repeatedly warned fintech firms that consent-heavy privacy notices confuse customers and expose firms to enforcement action.
A 2022 CNIL investigation found a French fintech lender was obtaining "blanket consent" for credit scoring, fraud detection, and marketing all in a single checkbox.
